Raw Fitness iTraining User Agreement
RCH Raw Fitness iTraining ('Service') is provided by RCH Ltd ('the Provider') in conjunction with PumpOne LLC ("PumpOne").
This User Agreement includes our Privacy Policy, information about security, disclaimers, health and safety and other important information. Please read the whole User Agreement. Please note that this User Agreement relates only to RCH practices and the RCH iTraining program.
By registering as a user of the service you confirm that you have the agreement of your GP to take part in the activities that form the service and that you agree to our Terms and Conditions which may vary from time to time. If in any doubt we suggest you refer to your GP before continuing. If you do not agree to the Terms and Conditions, please do not use the service.
Privacy
Protecting your privacy is very important to RCH. The technology on this website aims to target fitness programmes best suited to you. To do this we need to better understand your present condition and we do this through a Physical Activity Readiness Questionnaire (PAR-Q), a common industry approach to physical activity assessment. We recognise that the information provided in the questionnaire needs to be securely held because of its confidential and sensitive nature and our Privacy Policy ensures it stays so. Please read our statement below, which may be updated from time to time.
We do not sell your contact details to third parties. If you wish to remove your contact details from the Service, you may do so by contacting RCH at info@rawcorporatehealth.com
Use of Par-Q Data
RCH stores and maintains all Par-Q data collected by the Service. RCH reserves the right to use the data collected to aid in research and development of the Service. We will only use the data in an anonymous format in a way we deem responsible and correct (whether it be the sale, publishing, or any other use). RCH also reserves the right to do as we see fit with findings based on the data collected. If you cancel your registration to the Service, your Fitness Profile and Fitness Training Data are retained in a strictly anonymous format. We reserve the right to the continued use of that data. Fitness Profile and Fitness Training Data are the property of RCH.
Security
Whilst we make every effort to protect your personal information, we cannot ensure or warrant the security of any information that you transmit to us or that you transmit from the Application, and you do so at your own risk. Once we receive your transmission, we take all reasonable measures to ensure its security on our systems. We cannot be held liable for data that is lost or damaged, not retrievable, altered or misused.
Children's Guidelines
The Service is not directed to children under the age of eighteen (18), and RCH uses its best endeavours to prohibit registration by children under the age of eighteen (18). We will not knowingly collect or retain personally identifiable information from children under the age of eighteen (18).
If a child identifies himself/herself through the registration process to be under the age of eighteen (18), RCH will not knowingly allow the child to register for the Service or to have access to the Service. We use the PAR-Q (Physical Activity Readiness Questionnaire) as a screening tool. This questionnaire is one industry standard for assessing readiness for physical activity. The PAR-Q is not designed to assess activity readiness for individuals less than eighteen (18) years of age.
E-mail Communication to Users
RCH sends two types of communication to users:
1. Personalised feedback and motivational messages. These messages are sent to you automatically through your interaction with the Application. They will provide important information about your progress and recommend next steps.
2. General newsletters. RCH will distribute newsletters periodically to provide general information and updates to all users of the Application.
Both the feedback messages and general newsletters may also from time to time include special offers from RCH. The messages are sent directly from and regulated by RCH. You will not receive advertisements or offers directly from third parties.

No express or implied warranty or other guarantee is made as to the accuracy or completeness of any of the information or content contained in any of the pages in this web site or otherwise provided by personal training on the net. No responsibility is accepted and all responsibility is hereby disclaimed for any loss or damage suffered as a result of the use or misuse of any information or content or any reliance thereon. It is the responsibility of all users of this website to satisfy themselves as to the medical and physical condition of themselves in determining whether or not to use or adapt the information or content provided in each circumstance. Notwithstanding the medical or physical condition of each user, no responsibility or liability is accepted and all responsibility and liability is hereby disclaimed for any loss or damage suffered by any person as a result of the use or misuse of any of the information or content in this website, and any and all liability for incidental and consequential damages is hereby expressly excluded.
Except as otherwise required by law, all RCH or affiliate products and all products offered for sale through the RCH website are sold "as is," and any and all warranties, including any warranty implied by law, whether of merchantability, fitness for a particular purpose, or otherwise, are hereby expressly disclaimed, and any and all liability for incidental and consequential damages is hereby expressly excluded.
RCH suggests that you consult with your GP before following any training instructions you receive through the Service or participating in any event announced through the Application. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Taking part in any exercise or exercise programme brings with it the possibility of physical injury or death. If you feel discomfort or pain, do not continue.
We cannot be responsible for any health problems that may result from training programmes, products, or events you learn about through the Service. If you engage in any exercise program or activity you learn about through the Service, you do so at your own risk.
PLEASE NOTE: RCH reserves the right to refuse registration or terminate the existing usership at our sole discretion.
Guidelines for Users regarding E-mail
One of the ways RCH enables users to interact with the Service is through e-mail. If you use this service, you agree to follow the accepted user policies that govern Internet e-mail, and refrain from using the service to transmit "spam" or other unwanted solicitations, or any material that is harassing, threatening, racially offensive, obscene, abusive, harmful, defamatory, invasive of another's privacy, infringing of another's intellectual property rights, or illegal.
You are solely responsible for everything contained in any e-mail you send. RCH, in its sole discretion, may terminate your usership if it believes that you have violated the guidelines stated above. Users can be held legally liable for the contents of e-mail messages.
Copyrights
The Service and the e-mail communications you receive through use of the Service may contain copyrighted material. You agree that you do not acquire any ownership rights by downloading copyrighted material. RCH-copyrighted material may not be modified, published, transmitted, or displayed. You may not participate in the transfer or sale, create derivative works, or in any way exploit the content available on or through the Service, except as otherwise expressly permitted under copyright law or with the express permission of RCH and the copyright owner.
General
RCH, in its sole discretion, may refuse to provide its service to those who violate its guidelines or this User Agreement. This User Agreement shall be governed by the laws of England and Wales. Any action brought in connection with the User Agreement shall be filed within one year of the date of the alleged injury within the jurisdiction of the courts of England and Wales.
If you believe in any way that you have a medical condition or require medical intervention to resolve your health and fitness issues, the RCH iTraining program is NOT for you. You must be able to answer "NO" to all questions on the registration PAR-Q (Physical Activity Readiness Questionnaire) or be able to justify, with the written support of your GP, reasons for answering ‘NO' in order to join RCH iTraining.
As a user of the RCH iTraining program, there are additional terms and conditions that govern your use of the service and the website. Read these carefully before agreeing to become a subscriber of the RCH iTraining program and using the licensed material described below.
If you do not agree to these terms and conditions, you may not become a user or otherwise access the licensed material.
User Records and Procedures
Expulsion: The management may expel a User. If such expulsion is for violation of these terms and conditions or rules, or for any other conduct deemed detrimental to the general welfare of RCH, its employees, contractors, customers, or designees, monthly fees paid by the user shall be forfeited. All liability for any aspect of this contract ceases on cancellation.
House rules
1. User conduct. All users are required to conduct themselves in a manner that is not offensive or harassing to the usership of RCH iTraining or the staff/designees of the Provider. Inappropriate language and/or behaviour by a member will result in suspension or expulsion. Management has the sole right to determine what is and is not grounds for termination.
2. Hours of operation. The RCH iTraining program is delivered on a website that is available 24 hours a day, 7 days a week. Not withstanding the foregoing, there may be brief periods where the website is down for routine maintenance or to correct technical difficulties.
3. Amendments. Amendments to these terms and conditions may be made from time to time by management. Amendments to these terms and conditions will be posted at the www.rawcorporatehealth.com website and will be effective when posted. Your continued use of this website following the posting of any amendment, modification or change shall constitute your acceptance of these amendments.
You must stop any session if at any time you feel unwell or experience any pain and you must inform your GP and coach before continuing with any further exercise programme.
Please ask your personal trainer any questions you may have regarding your exercise programme or specific activities.
Your participation in your exercise programme is voluntary and you are free to discontinue at any time. However, you understand that by signing up to the time periods stipulated that at no stage are you entitled to a refund when leaving the programme early.
You recognise that RCH Ltd have limits to confidentiality as described in the House Rules above. You have read and agreed to the above terms and conditions, including the waiver and release of liability; you fully understand and agree to its terms and conditions.

www.rawcorporatehealth.com reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our sole discretion which we will notify you by email. There are no refunds with iTraining.
2. Privacy - Please review our Privacy Policy under the User Agreement above, which also governs your visits to, and use of www.rawcorporatehealth.com
3. Access to www.rawcorporatehealth.com - We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction in service.
4. Licence for website access - Raw Corporate Health Ltd grants you a limited licence to access and make personal use of this website www.rawcorporatehealth.com, but not to download (other than purchasing iTraining or newsletters) or modify it, or any portion of it, except with express written consent of Raw Corporate Health Ltd. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

Conditions Relating to the Sale of Products to You

10. Our contract - When you place an order to purchase a product from Raw Corporate Health Ltd iTraining in conjunction with PumpOne, you will receive an email link to download your trainer, which will then sync to your iPod or can be printed out.
11. Returns - We do not offer returns with regard to iTraining programs.
This returns policy does not affect your statutory rights.
12. Customs - When ordering goods from Raw Corporate Health Ltd for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Raw Corporate Health Ltd, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. Raw Corporate Health Ltd does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty.
17. Alteration of Service or Amendments to the Conditions - We reserve the right to make changes to our website, policies, and these Terms & Conditions at any time. You will be subject to the policies and Conditions of Use & Sale in force at the time that you use the website or that you order products from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
18. Events beyond our reasonable control - We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
19. Waiver - If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
20. Governing law and jurisdiction - These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
